The materials on Play and Learn website are provided on an ‘as is’ basis. Play and Learn makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, Play and Learn does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
Orders
All orders are subject to these terms and conditions issued by Play And Learn, and shall override and exclude any conditions stipulated or referred to by the purchaser. Most of our products are procured internationally. Orders are accepted and delivery estimates given conditionally on our being able to secure the necessary material and without responsibility for delays or nonfulfillment arising through risk and uncertainties, strikes, accidents, force majeure, or any other circumstances outside our control.
Pricing
Prices will be held firm for deliveries made during the validity period of a quotation. We reserve the right, thereafter, to invoice at the price ruling at the date of dispatch. Prices do not include installation costs. We reserve the right to make an increased charge in the event of suspension of work on equipment by reason of the customer’s instruction.
Acceptance
All quotations are subject to written confirmation on receipt of order and are not binding until confirmed.
Delivery
Time of delivery is subject to confirmation upon receipt of order. The time of delivery shall not be of the essence of any contract and no responsibility is accepted for delays in delivery however arising. Any provision for penalties for delay in delivery or otherwise are hereby excluded.
Payments
Play And Learn is the name that will appear on delivery notes, invoices and your credit/debit card statement, or bank statement. Account payment terms are subject to approval. All payment information will only be used for that transaction and will be securely processed by our bank card payment system. We will not store your financial information, but may store your contact details and may send you details at future times with offers unless you ask us not to.
Cancellation
We cannot accept cancellation of orders for goods made specifically to customer’s requirements. We reserve the right to make a minimum cancellation charge of 25% of the price of goods on orders from our listed products and to charge for return haulage where applicable. Orders shall not be cancelled or amended unless so agreed in writing and upon terms which provide indemnity against any loss incurred by Play And Learn as a result of cancellation.
Liability
Claims for non-delivery must be made to Play And Learn within 7 days from the date of the invoice. Damage or discrepancy must be notified to the carrier upon receipt of goods and to Play And Learn within 24 hours of receipt of goods.
Warranty Policy
All the products in Play and Learn are sourced through various suppliers. Play and Learn does not give any special warranty for any products, however, the terms of the respective supplier’s warranty will apply.
Accuracy of materials
Play And Learn will ensure that the product supplied is of the highest quality and either same or similar to what is shown on the website. The materials appearing on Play and Learn’s website could include technical, typographical, or photographic errors. Play and Learn does not warrant that any of the materials on its website are accurate, complete or current. Play and Learn may make changes to the materials contained on its website at any time without notice. However, Play and Learn does not make any commitment to update the materials.
Limitations
In no event shall Play and Learn or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Play and Learn’s website, even if Play and Learn or a Play and Learn authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
